Mediation

More and more progressive employers are discovering the benefits of resolving difficult workplace problems through mediation.

Mediation is moving into the mainstream of workplace conflict resolution.  It is explicitly recommended in the foreword to the revised ACAS Code of Practice as a dispute resolution option.  As the cost of litigation increases, there has never before been a greater impetus for employers and employees to explore mediation as an alternative to litigation. 

While mediation is not appropriate for all cases, it can be an effective and (potentially) much less expensive alternative to litigation.

Mediation has the following benefits over traditional methods of litigation:

  • Both parties invest in the outcome
  • The outcome is controlled
  • Both parties have greater control over costs
  • Reputation risks can be more effectively managed
  • Both parties can concentrate on getting a result which will work for them
  • No point-scoring, just problem-solving
  • High success rate (the vast majority of mediated disputes are resolved)
